IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF DIGIERA360° FOR ALL CLAIMS, DAMAGES, AND LOSSES (WHETHER IN CONTRACT, TORT, OR OTHERWISE) RELATING TO THE SERVICES OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DIGIERA360°, IF ANY, FOR ACCESS TO OR USE OF THE SERVICES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INDIAN RUPEES ONE THOUSAND ONLY (INR 1,000/-).

10. Indemnification and Hold Harmless

You agree to defend, indemnify, and hold harmless DigiEra360°, its licensee and licensors, and their respective employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorney’s fees) arising from:

  • Your use and access of the Service, by you or any person using your account and password.
  • Your breach of any provision of these Terms.
  • Your violation of any rights of another, including intellectual property rights.

11. Governing Law and Exclusive Jurisdiction

You and DigiEra360° irrevocably agree that the courts in Ballari, Karnataka, India shall have exclusive jurisdiction to settle any dispute, claim, or controversy arising out of or relating to these Terms, the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Website or Services. You hereby expressly waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inconvenient forum.

These Terms, together with our Privacy Policy and any other legal notices published by DigiEra360° on the Website, constitute the entire and exclusive agreement between you and DigiEra360° concerning the Services, superseding any prior agreements, communications, and proposals, whether oral or written, between you and DigiEra360°.
